Terms & Conditions

1. Website Terms of Use

These Website Terms of Use apply to anyone who browses or uses www.stakelums.ie (the "Website"). By using the Website, you accept these Terms. If you place an order, our separate Online Sales Terms also apply to that purchase.

1.1 About Us

The Website is operated by Stakelums Home & Hardware ("Stakelums", "we", "us", "our"), trading from Racecourse Retail Park, Racecourse Road, Thurles, Co. Tipperary, E41 H9C7, Ireland.

Customer service: Instore: (0504) 21900 · retail@stakelums.ie Online: websales@stakelums.ie

1.2 Eligibility and Accounts

The Website is intended for use by persons aged 18 or over. If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at websales@stakelums.ie if you suspect any unauthorised use.

1.3 Intellectual Property

All text, images, logos, product descriptions and other content on the Website belong to Stakelums or our licensors and are protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use, but you may not copy, reproduce, republish or distribute any content from the Website without our prior written permission.

1.4 Acceptable Use

You agree to use the Website only for lawful purposes. You must not:

  • attempt to gain unauthorised access to the Website, our systems, or any account other than your own;
  • introduce viruses, malware or other harmful code;
  • scrape, copy or resell our product data or pricing for commercial purposes without permission;
  • use the Website in any way that could damage, disable or impair it, or interfere with anyone else's use of it.

1.5 Accuracy of Content

We take reasonable care to keep product information, pricing and images on the Website accurate and up to date. However, images are for illustration and may differ slightly from the actual product (particularly for paint colours, wood finishes and fabrics), and occasional errors can occur. Where there is a pricing or description error, see Section 2.3 of our Online Sales Terms for how this is handled.

1.6 Third-Party Links

The Website may link to third-party websites (for example, delivery partners, finance providers, or social media). We do not control these sites and are not responsible for their content, availability or practices. Following a link is at your own risk.

1.7 Disclaimer and Liability

We provide the Website "as is" and do not guarantee that it will always be available, uninterrupted, or free of errors. Nothing in these Terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2022.

We do not exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be excluded or limited under Irish law.

Subject to the above, our liability to you for losses arising from your use of the Website (as opposed to a specific order, which is covered by our Online Sales Terms) is limited to direct losses that were reasonably foreseeable, and we are not liable for indirect or consequential losses, or for loss of business, profits or data.

1.8 Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in the law or in how the Website works. The current version will always be available on this page, and it applies from the date it is posted.

1.9 Governing Law

These Terms are governed by Irish law, and the Irish courts have exclusive jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer protection rights you may have in your country of residence.

2. Online Sales Terms

These Online Sales Terms apply whenever you place an order through www.stakelums.ie. They sit alongside our Website Terms of Use, our Delivery & Collection information, and our Returns Policy — together, these documents form the full terms of your purchase.

2.1 How a Contract Is Formed

Products shown on the Website are an invitation for you to make an offer to buy, not an offer by us to sell. When you place an order, you are making us an offer. We will send you an email acknowledging receipt — this is not acceptance of your order. A binding contract is only formed when we send you a dispatch confirmation (or, for Click & Collect, a "ready for collection" notice), or when we actually supply the product to you, whichever happens first.

2.2 Order Acceptance

We may decline or cancel an order at any stage before dispatch, for example where:

  • the product is not actually in stock or has been discontinued;
  • we identify a pricing or description error (see 2.3 below);
  • we suspect fraud, or the order breaches these Terms;
  • we're unable to obtain authorisation for your payment.

If we cancel an order after payment has been taken, we will refund you in full, including any delivery charge you paid, within 14 days.

2.3 Pricing and Payment

All prices on the Website are shown in euro and include VAT at the applicable Irish rate, unless stated otherwise. Delivery charges are shown separately at checkout before you complete your order.

Occasionally a product may be listed at an incorrect price due to a technical or human error. If we discover this after you've ordered, we will contact you to ask whether you'd like to proceed at the correct price or cancel the order, and we will not dispatch the product until you've confirmed. If we're unable to reach you within a reasonable time, we'll treat the order as cancelled and refund any payment made.

We accept the payment methods shown at checkout (currently including major debit/credit cards and, where selected, humm Finance). Payment is taken at the point of order.

2.4 Delivery

Delivery times and charges are set out on our Delivery & Collection page, which forms part of these Terms. Delivery dates given at checkout or by email are estimates, not guaranteed delivery times, and can occasionally be affected by matters outside our control (courier delays, stock issues, severe weather, etc.).

If we're unable to deliver within 30 days of the date we agreed (or, where no date was agreed, within 30 days of your order), you may treat the contract as at an end and are entitled to a full refund, in line with your rights under the Consumer Rights Act 2022 — unless we've agreed a longer, specific delivery date with you for the item in question (as can happen with made-to-order furniture, for example).

Risk in the products passes to you once they've been delivered to you or to a person you've nominated to receive them (for example, someone else at your address). Ownership of the products passes once we've received payment in full.

2.5 Your Right to Cancel

If you're a consumer buying online, you have a statutory right to cancel your order within 14 days of receiving the goods, without giving a reason, under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013. Full details of how to exercise this right, which items are excluded (such as hygiene-sealed products and specially mixed paint), and how refunds are processed are set out in our Returns Policy, which forms part of these Terms.

This is separate from, and in addition to, your statutory rights if a product is faulty, not as described, or not fit for purpose under the Consumer Rights Act 2022 — those rights don't have a 14-day limit and are also covered in our Returns Policy.

2.6 Force Majeure

We won't be responsible for any delay or failure to perform our obligations under these Terms where this is caused by circumstances beyond our reasonable control, including extreme weather, industrial action, supplier failure, or similar events.

2.7 Complaints

If something's gone wrong with your order, please contact our Online Customer Service team first at websales@stakelums.ie or (0504) 21900, so we can put it right. If you remain unhappy once you've been through our complaints process, you can contact the Competition and Consumer Protection Commission (www.ccpc.ie) for guidance on your consumer rights, or pursue the matter through the Irish courts or an appropriate alternative dispute resolution body.

2.8 General

If any part of these Terms is found to be unenforceable, the rest will remain in full effect. These Terms are governed by Irish law and the Irish courts have exclusive jurisdiction, without prejudice to any mandatory consumer rights you have in your country of residence.
